These Terms of Service are a legal agreement between you and Oshizi ("Oshizi", "we", "us", or "our") and govern your access to and use of Oshizi websites, games, accounts, applications, pages, content, tools, and related services, including oshizi.com, AppleGame+, ColorTiles+, and any other Oshizi service that links to these Terms (collectively, the "Service").
By accessing or using the Service, creating an account, playing a game, joining a room, submitting content, or otherwise interacting with the Service, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.
These Terms incorporate by reference our Privacy Policy and Community Rules.
1. The Service
Oshizi operates web games, game-related services, public websites, tools, articles, research pages, community features, and related online services.
The Service may include, without limitation, single-player games, multiplayer games, custom rooms, random matchmaking, spectator features, replays, rankings, score records, medals, accounts, user settings, nicknames, reports, forms, advertisements, analytics, and related features.
We may add, change, suspend, or discontinue any part of the Service at any time, with or without notice.
2. Eligibility
You must be at least 13 years old to use the Service.
If you are under the age of majority in your country or region, you may use the Service only with permission and supervision from a parent or legal guardian.
You may use the Service only if you are legally allowed to do so under the laws that apply to you.
3. Accounts
Some parts of the Service may allow or require you to create an account. Account registration may require a username and password. Email address may be optional, unless a specific feature requires email for verification, recovery, support, security, or other account-related purposes.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your account.
You agree that you will not:
- create an account using false, misleading, offensive, infringing, impersonating, or abusive information;
- use a username that violates these Terms or the Community Rules;
- share, sell, transfer, trade, lend, or give access to your account;
- access another user's account without permission;
- create or use accounts to evade restrictions, bans, rate limits, moderation actions, or enforcement measures;
- mass-register accounts or use automated account creation;
- use accounts to manipulate matchmaking, rankings, rooms, replays, reports, records, or service integrity.
We may rename, restrict, suspend, or terminate accounts that violate these Terms, the Community Rules, or the integrity of the Service.
You must notify us promptly if you believe your account has been accessed without authorization.
4. License to Use the Service
Subject to these Terms, Oshizi grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, non-commercial purposes.
This license does not transfer ownership of the Service or any part of it. All rights not expressly granted to you are reserved by Oshizi and its licensors.
You must not copy, modify, distribute, sell, lease, exploit, reverse engineer, interfere with, or create derivative works from the Service except to the extent permitted by applicable law.
5. User Content
"User Content" means any content or information you submit, transmit, display, upload, or otherwise make available through the Service, including usernames, nicknames, room titles, messages, reports, feedback, form submissions, and other materials.
You are responsible for your User Content. You represent and warrant that you have all rights necessary to submit your User Content and that your User Content does not violate these Terms, the Community Rules, applicable law, or the rights of any third party.
You retain any ownership rights you have in your User Content. By submitting User Content, you grant Oshizi a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, modify, adapt, moderate, remove, process, and use that User Content as necessary to operate, protect, maintain, and improve the Service.
We are not required to monitor, preserve, publish, or respond to User Content. We may remove or restrict User Content at any time if we believe it violates these Terms, the Community Rules, applicable law, or the safety or integrity of the Service.
6. Games, Scores, Rankings, and Replays
Oshizi games may include rooms, matchmaking, scores, rankings, medals, replays, spectators, public results, share pages, and similar game-related features.
Game records may include gameplay actions, scores, board states, timing data, room data, player identifiers, rankings, replay data, and related metadata. Some game records may be visible to other users, spectators, room hosts, or viewers of public result pages.
We do not guarantee that any score, ranking, medal, replay, room, match history, account record, or other game data will remain available, accurate, complete, or unchanged.
We may remove, hide, correct, invalidate, or refuse to display any score, ranking, medal, replay, room, username, nickname, match, record, or other data if we believe it is inaccurate, abusive, manipulated, unlawful, harmful, or inconsistent with these Terms or the Community Rules.
Scores, rankings, medals, replays, accounts, usernames, rooms, and similar features have no cash value and do not create any property right.
7. Room Hosts and Room Controls
Some games may allow users to create or host rooms. Room hosts may have room-level controls, such as starting games, changing settings, approving or denying entry, resetting nicknames, kicking users, or banning users from a room.
Room-level controls are provided for convenience and moderation within a room. They do not give a host ownership of the Service or authority to violate these Terms or the Community Rules.
We may override, limit, remove, or review room-level actions if needed to protect the Service or other users.
8. Prohibited Conduct
You must not use the Service for any unlawful, harmful, abusive, fraudulent, deceptive, or disruptive purpose.
You agree that you will not:
- cheat, attempt to cheat, or help others cheat;
- use macros, bots, scripts, solvers, automation, packet tampering, modified clients, replay forgery, timer manipulation, or unauthorized assistance tools;
- exploit bugs or vulnerabilities instead of reporting them responsibly;
- disrupt rooms, matchmaking, rankings, accounts, replays, infrastructure, or other users;
- harass, threaten, dox, impersonate, defame, abuse, or target others;
- submit hateful, sexually explicit, violent, misleading, infringing, unlawful, or otherwise harmful content;
- spam, flood, scrape, harvest, overload, or attack the Service;
- attempt to access non-public systems, accounts, rooms, sessions, data, admin tools, or APIs;
- evade bans, account restrictions, room restrictions, rate limits, IP blocks, anti-abuse systems, or other enforcement measures;
- use the Service in a way that damages Oshizi, other users, third-party services, or service integrity.
The Community Rules provide additional rules for gameplay, accounts, chat, rankings, rooms, and fair play.
9. Advertising, Analytics, and Third-Party Services
The Service may include third-party services, including hosting providers, analytics providers, advertising networks, content recommendation services, embedded media, security providers, and external links.
Third-party services are governed by their own terms and privacy policies. Oshizi is not responsible for third-party content, availability, security, privacy practices, advertising practices, or services.
Advertisements may appear on pages within the Service, including landing pages, result pages, replay pages, article pages, and other non-gameplay or surrounding surfaces. We may change advertising placement, providers, or formats from time to time.
10. Availability and Maintenance
The Service is provided on an "as is" and "as available" basis.
We may modify, suspend, restrict, or discontinue any part of the Service at any time. The Service may be unavailable because of maintenance, errors, security issues, traffic spikes, infrastructure failures, third-party failures, or other causes.
We are not responsible for loss of access, data, accounts, rankings, scores, replays, rooms, settings, User Content, or other records resulting from downtime, maintenance, changes, bugs, security measures, or service discontinuation.
11. Enforcement
If we believe that you have violated these Terms, the Community Rules, applicable law, or the integrity of the Service, we may take action with or without prior notice.
Enforcement actions may include, without limitation:
- warnings;
- username or nickname resets;
- content removal;
- room removal;
- room-level restrictions;
- matchmaking restrictions;
- score, medal, ranking, or replay removal;
- invalidation of game records;
- account restrictions;
- account suspension or termination;
- password reset requirements;
- email verification requirements;
- rate limits;
- IP, network, device, or session restrictions;
- blocking access to all or part of the Service;
- reporting to service providers, infrastructure providers, or authorities where appropriate.
We are not required to disclose detection methods, moderation methods, anti-cheat signals, security logic, or internal enforcement criteria.
12. Intellectual Property
The Service, including software, source code, game logic, game design, visual design, text, graphics, logos, user interface, documentation, databases, and other materials, is owned by Oshizi or its licensors and is protected by applicable intellectual property laws.
You may not use Oshizi names, logos, branding, or assets in a way that suggests endorsement, sponsorship, or affiliation without written permission.
Nothing in these Terms gives you ownership of any part of the Service.
13. Feedback
If you provide suggestions, ideas, bug reports, or other feedback, you agree that Oshizi may use that feedback without restriction or compensation to you.
14. Termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate your access to the Service at any time if we believe it is necessary to protect the Service, other users, third parties, Oshizi, or legal compliance.
Any sections that by their nature should survive termination will survive, including sections concerning intellectual property, User Content licenses, disclaimers, limitation of liability, indemnity, and governing law.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express, implied, or statutory.
Oshizi disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, uninterrupted operation, and error-free operation.
We do not warrant that the Service will meet your requirements, remain available, preserve data, prevent cheating or abuse, or operate without errors, interruptions, vulnerabilities, or harmful components.
You use the Service at your own risk.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Oshizi and its owners, operators, affiliates, contractors, service providers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, accounts, access, rankings, scores, replays, records, or service availability, arising out of or relating to the Service.
To the maximum extent permitted by applicable law, Oshizi's total liability for all claims arising out of or relating to the Service will not exceed the greater of USD 100 or the amount you paid directly to Oshizi for the Service during the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability where such limitation is not permitted by applicable law, including liability arising from intentional misconduct or gross negligence where such liability cannot be excluded by law.
Some jurisdictions do not allow certain disclaimers or limitations of liability. In those jurisdictions, the limitations apply to the fullest extent permitted by law.
17. Indemnity
You agree to defend, indemnify, and hold harmless Oshizi and its owners, operators, affiliates, contractors, service providers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or relating to:
- your use of the Service;
- your User Content;
- your violation of these Terms or the Community Rules;
- your violation of applicable law or third-party rights;
- your cheating, abuse, automation, attacks, unauthorized access, or other misconduct.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules, except where mandatory consumer protection laws provide otherwise.
Any dispute arising out of or relating to these Terms or the Service shall be submitted to the competent courts under the laws of the Republic of Korea, unless mandatory applicable law provides otherwise.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the "Last updated" date.
Your continued use of the Service after updated Terms are posted means that you accept the updated Terms.
